The Last Will and Testament is often the last chance an individual has to inform a court of their choice for the custody of their children. In a case where both parents pass away in an unexpected accident or tragedy, the Last Will specifically states where parents prefer that their children spend the rest of their childhood. The statement of a parent regarding which environment they believe will be best suited for their children provides a judge the ability to consider the wishes of the parent. This vital piece of information may play heavily in a hotly contested custody case between well-meaning grandparents or other family members.
